Terms of Service

These Terms of Service govern your use of Halesahcars ("the Platform"). By accessing or using our website, you agree to be bound by these Terms.

1. Nature of the Platform

Please read carefully: Halesahcars is strictly a display and listing platform. We act solely as a bulletin board to connect potential car buyers and sellers.

  • We do not inspect the vehicles.
  • We do not process payments.
  • We do not facilitate the actual transfer of ownership or title.
  • We are not a party to any transaction or agreement made between buyers and sellers.

2. User Accounts (Sellers)

  • Phone Number Login: Sellers must use a valid mobile phone number to register and log in via SMS One-Time Password (OTP).
  • Account Security: You are responsible for maintaining the security of your phone and SIM card. You agree not to share your OTP with anyone.
  • Accuracy: You agree to provide accurate, truthful, and up-to-date information when creating listings.

3. Listings and Prohibited Content

Sellers must have the legal right to sell the vehicle they are listing. You may not post:

  • Stolen vehicles or vehicles with salvage or fraudulent titles.
  • False information regarding the car's condition, mileage, or history.
  • Illegal content, hate speech, or offensive material.

We reserve the right to remove any listing at our sole discretion, without prior notice.

4. Off-Platform Communication and Transactions

CRITICAL WARNING: All communication and negotiations between buyers and sellers occur off our platform (e.g., via WhatsApp, phone calls, or in person).

  • Because we do not monitor off-platform communications, we have no control over the interactions between users.
  • You assume all risks associated with off-platform transactions.
  • We strongly advise users to verify the identity of the other party, inspect the vehicle in person, and verify the vehicle's title and history before exchanging any money.

5. No Liability for Scams or Disputes

Due to the off-platform nature of our service, users are solely responsible for protecting themselves against fraud, scams, and misrepresentation. Halesahcars is not liable for any disputes, financial losses, physical harm, or damages arising from transactions or communications between users. If you are scammed, you must resolve it directly with the other party or report it to local law enforcement.

6. Prohibited Activities

Users (both buyers and sellers) agree not to:

  • Use the platform to scrape data or build a competing service.
  • Spam other users or post fake listings to generate leads.
  • Attempt to bypass our SMS OTP security measures.

7. Disclaimer of Warranties

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the reliability of the site, the accuracy of the car listings, or the legitimacy of the sellers. We do not guarantee that the site will be uninterrupted or error-free.

8. Limitation of Liability

To the maximum extent permitted by law, Halesahcars, its owners, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or goodwill, arising out of your use of the platform or any transactions entered into with other users.

9. Indemnification

You agree to indemnify and hold harmless Halesahcars from any claims, damages, losses, or legal fees arising out of your violation of these Terms, your listing of a vehicle you do not legally own, or any disputes you have with other users.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Malawi. Any legal disputes shall be resolved in the courts of Malawi.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating the "Last Updated" date at the top of this page. Your continued use of the site constitutes acceptance of the updated Terms.
